Welcome to this virtualSecond owned and operated sim.

Please read through this covenant as it contains important information. Make sure you understand and accept it before making a purchase. By purchasing land you agree to the rules and regulations as laid out in this covenant. Failure to understand, accept and follow the covenant could lead to eviction from the sim.

A Declaration of Independence and Ownership
This sim is privately owned and operated by ServMe Nakamura under the virtualSecond brand, and is independent from Linden Lab®. This means that you don't need a premium account with Linden Lab® to own land here, and that all rules, regulations and guidelines on this sim are set by the owner. The owner has final decision making power and has the right to accept or deny applications of residents wanting to move to the sim, to change the covenant as needed, and to grant or remove rights as they deem necessary.

NOTE : Please be advised that a lot of messages are being exchanged on a daily basis, so it can take several hours to hear back from us. If you have received no reply within 48 hours, please send your message to ServMe Nakamura using a notecard titled like this :

SUMMARY : This is a privately owned sim. You don't require a premium account with Linden Lab® to rent or purchase land on this sim. All tier payments will be made to ServMe Nakamura unless stated otherwise. In case of dispute between renters, owners or with the sim owner, the sim owner has the final world and their ruling will be decisive.

1. Purchasing Land and Tier payments
* Land Purchases : You don't need a Second Life® Premium account to purchase land on virtualSecond sims. If you find land on the sim that is listed for sale by ServMe Nakamura, you are certain it is backed by the estate owner and you can pay the purchase price and own it immediately. However, be advised that you will be required to pay a monthly tier (see below). Failure to pay full monthly tier within 24 hours after your land purchase will result in the land being reclaimed without refund.
Attempting to sell your land before making tier payment will result in an immediate ban in all virtualSecond sims.

Buyers looking to purchase from a third party owner (land not listed for sale by ServMe Nakamura) are strongly encouraged to contact virtualSecond Staff before purchasing the land. Staff can be reached at staff@virtualsecond.com, or contact any of the people in the virtualSecond Staff group in world.

After purchase, please send a mail to tier@virtualsecond.com with the following details :

your Second Life® name (required)
a secondary e-mail address where we can reach you (optional)
the transaction ID of the land purchase (optional) [you can find that in your transaction history on the SL website]

* Tier payments : All land on the virtualSecond sims are linked to a tier system. Paid tiers will never be refunded. Tier is due within 24 hours after the initial land purchase, and after that on the 15th of each following month, for as long as you own land. If tier payment is not received on the 17th, a warning MAY be given and land will be reclaimed within 24 hours unless payment is received.

1025 - 2048 sqm : L$ 4,100
2049 - 3072sqm : L$ 6,150
3073 - 4096 sqm : L$ 8,200
4097 - 5120 sqm : L$ 10,250

6145 - 7168 sqm : L$ 14,350

Example : You purchase a 1024sqm lot on a virtualSecond sim. Your monthly tier of L$2,050 is due 24 hours after purchase. You purchase an extra 2048sqm of land in the same tier period, bringing your total to 3072sqm. You will need to pay L$4,100 in tier within 24 hours (L$6,150 - L$2,050 already paid = L$4,100). Next tier period, you will pay L$6,150 in tier.

Your first tier payment is always for a full month, no matter what date the purchase is made. The second month of tier will be prorated, and you will be told the exact amount due.

Prorated example 1 : You purchase 1024sqm on the 30th. Your tier payment of L$2,050 is due within 24 hours. Next period (on the 15th) you will only pay a prorated tier of L$1,025.

2. Zoning regulations
The virtualSecond sims can be either residential, commercial or a healthy mix of both. In the interest of all the sim users, visitors and land owners, some regulations are in effect to make it an enjoyable place for everyone.

Skyboxes should be placed at an altitude of 375 meter or higher.
You can not put up ban lines or parcel access restrictions on your land. If you want privacy, please use a security system (see below) and/or move to a skybox above 375m. Banlines are ugly and take away from the general experience and free flow of people in a sim. If you want more information about this, contact virtualSecond Staff.
All constructions should be under 40m in height and blend in with the overal look in the neighborhood. Look around for guidelines - if complaints are made, virtualSecond Staff will judge and decide in the matter and may ask you to make changes.
Terraforming is not permitted.
Subdividing and Joining : Land can not be subdivided. We can join adjecent lots if you purchase both and no public zone is in between them.
Advertising is not allowed on virtualSecond sims. There will be a few adboards available on the sims in or near public zones which can be rented to promote your business. Businesses are allowed to have their name or logo on the outside of their commercial building, providing it blends in with the neighborhood. Rotating, flashing or particle emmitting eyesores will be removed without warning.
Parcel boundaries are to be respected. Make sure you keep your prims inside the parcel boundaries, this does include particles! Failure to do so may lead to complaints being made and you don't want that (see Global Behaviour Policy).
Clubs and entertainment venues (including those of an adult nature) are not allowed on any virtualSecond sim, unless prior written approval from the sim owner has been obtained. If you purchase land to build a such a business before obtaining permission by mail, you assume all risk. Clubs or entertainment venues operating without approval will be removed without warning and land reclaimed without refund. Obtained permissions are not transferable to other venues, land or management. Decisions will be made case by case, and sim owner decisions are final.

3. Global Behavior Policy
This policy applies to all guests and residents of any virtualSecond sim, while on any virtualSecond sim. These rules are set to protect users against harassment and disruptive behavior. If someone is violating any of these rules, please contact virtualSecond staff.

Harassment : We take a very strong stance when it comes to the harassment of other users. Due to the wide range of possibilities open in Second Life®, we do not have a strict definition of harassment; however, this includes spam advertising to other residents, use of weapons, and other abusive conduct. All harassment will be dealt with quickly and properly. virtualSecond Staff will decide on whether something is, or is not, considered harassing. In the mean time, victims of harassment as encouraged to file an Abuse Report with Linden Lab®.
Security Systems : Security Systems are allowed on the virtualSecond Sims. If you use a security system, it should be set to warn and provide at least a 15 second delay before taking any action. Failure to set up your security system like this will have it disabled and a warning will be given.
Resource consumption and lag: If you have objects or scripts which significantly negatively impact the ability for the sim (Region) to operate in an efficient manner (such as causing time dilation), we will ask you to cease using the items. This also applies to objects which can cause regions to crash, or cause frame rates for viewers to drop to a significant degree. If these items are not dealt with in a timely manner, virtualSecond Staff has the right to disable the script, return the item to you, or completely ban/delete the item altogether. Additional Note : Devices that allow you to temporary rezz objects do have a serious impact on sim performance, especially if multiple devices are used. The use of these devices will be prohibited if they consume too much resources or degrade sim performance. Please check with virtualSecond Staff if you have questions relating to these rules.
Adult/Mature Content : The virtualSecond sims are rated Mature, to protect the freedom of our users in the best possible way. However, we strongly advise you to keep mature content inside your building or house. Minors are not allowed on the virtualSecond sims and we will ban avatars that are under age and report those to Linden Lab®. If you have mature content on your land, please flag it as such.
Penalty for Violations : You are - as a renter, owners or group member - responsible for your guests and your fellow group members. If they are caught violating the rules and can be traced back to you, you will receive a warning. Only two warnings will be given, a third complaint will get your land reclaimed without refund, your items returned to you and estate wide bans may be enforced. You will have ample time to deal with complaints, and we don't reclaim or ban lightly.

The Global Behaviour Policy is living matter and we don't aim to include every single type of abuse in this policy. It is not because something is not listed in this policy that it is acceptable by any means. The policy is a framework that can be altered as situations change over time.

4. Selling Land, Abandoning Land and Tier Payments
Land can be resold on virtualSecond sims, so we will not purchase the land back from you. The buyer is responsible to make full tier payment within 24 hours after purchase, tier paid by the previous owner is is not transferable nor deductible. Attempting to sell your land before tier has been paid will result in an immediate ban in all virtualSecond sims.

Failure to pay tier in due time will result in land being reclaimed without refund. If you wish to abandon your land, you can either stop paying tier and wait for it to be automatically reclaimed, or send a mail to tier@virtualsecond.com and express the desire to have us reclaim it immediately. The latter would freeze upcoming tier charges and end your ownership instantly. You will however remain responsible for past (outstanding) tier payments if those exist, even if you abandon your land and we will take action to collect the fees due.

5. Liabilities
While management will do everything reasonably possible to make the experience as pleasant as possible, the sim and usage of it is delivered as is. We can not be held liable for unavailability due to grid problems, packets dropped or anything else that prevents you from accessing your land or the sims. We are at the mercy of the LL gods as much as you are ;-)
